At one point in the January hearing, defense lawyer Marlo Cadeddu told the judge her team had not received underlying documentation to substantiate the prosecution's position that the credit card charges for which they were seeking to hold Brown responsible occurred after the posting of the link.

In response, the judge made it clear that the word of the FBI was good enough for him:

Judge Lindsay: Let me ask you this. If the agent testified to that, what evidence do you have to contradict that? In other words, if there is testimony that it occurred as he said it did, what do you have to contradict that? To say that you have no supporting documentation does not necessarily refute what the agent has testified to.

Prosecutor Lindsay Heath later claimed to have provided the evidence to the defense, but the point is the judge will believe what the FBI says.
